Terms of service

1. Informacje ogólne

This document clearly defines the terms of service provided by Mateusz Słowikowski, hereinafter referred to as the Service Provider, operating as an unregistered business. Services are provided to both individuals and business entities. Contact with the Service Provider is available via email at [email protected] for all related inquiries. Using the services constitutes acceptance of these terms.

2. Scope of services

The services include in particular:

  1. designing and developing websites,
  2. modification and expansion of existing websites,
  3. deployment of the website for operation,
  4. technical support within a scope agreed individually.

The detailed scope of each service is agreed individually with the client.

3. Terms of execution

  1. The execution of the service begins after the scope, price, and deadline have been agreed.
  2. The client is obliged to provide the materials necessary for the completion of the project.
  3. Project deadlines may change in the event of delays resulting from reasons attributable to either the client or the Service Provider.

4. Payments

  1. The price of the service is agreed individually before work begins.
  2. Payment may be made as a one-time payment or in stages, as agreed.
  3. Failure to make timely payment may result in suspension of the service.
  4. Available payment methods include bank transfer, BLIK, and PayPal.
  5. Payments via bank transfer and BLIK are processed through HotPay, while PayPal payments are processed through PayPal.
  6. All prices are listed in Polish złoty (PLN) for clients in Poland and in US dollars (USD) for clients outside Poland, with the USD amount converted from PLN based on the applicable exchange rate on the payment day.
  7. Prices include VAT however, the Service Provider benefits from VAT exemption due to operating as an unregistered business.

5. Terms of contract formation and termination

  1. A contract is concluded when the client confirms it in writing via message after the scope and price of the service have been agreed upon by both parties. By accepting the contract, the client simultaneously accepts the terms of service.
  2. In the case of hosting, the contract is automatically concluded upon activation of the 14-day trial period after properly notifying the client, and the client determines the terms of continued hosting.
  3. Each contract may be terminated by the client or the Service Provider electronically by sending a message at anytime.

6. Right of withdrawal

For services provided by the Service Provider exclusively in digital form, the client does not have the right to withdraw from the contract if the service has commenced within 14 days of the contract conclusion after receiving all necessary materials and information from the client required for its execution.

7. Copyright

Copyright to the completed project is transferred to the client after full payment has been made, unless otherwise agreed. The Service Provider retains the right to present the project in their portfolio.

8. Liability

  1. The Service Provider is not responsible for content provided by the client or published on the website.
  2. The Service Provider is not liable for interruptions in website operation resulting from causes beyond control.

9. Complaints

The client has the right to submit comments or complaints regarding the completed service. Complaints are reviewed within 14 days of receipt.

10. Website hosting

  1. The Service Provider may offer website hosting services for clients.
  2. With each order, the client receives hosting as a 14-day trial period, during which they agree with the Service Provider on the terms of continued hosting. If the client opts out or does not make a decision, the hosting will be disabled no later than at the end of the trial period.
  3. Hosting is provided through recurring payments or an upfront fee for a specified period.
  4. After the paid period expires, the Service Provider allows an additional 7 days for payment.
  5. If payment is not received after this time, the hosting service may be deactivated.
  6. The client bears full responsibility for the content placed on the hosted website.
  7. The Service Provider is not responsible for the consequences of hosting deactivation resulting from non-payment.

11. Domain names

  1. At the client’s request, the Service Provider may register a domain on their behalf.
  2. In such cases, the client grants the Service Provider the right to represent them before the domain registrar solely for the purpose of domain registration and configuration.
  3. The Service Provider is not directly responsible for the use of the domain or content published under it by clients in general.
  4. Domain registration and configuration is a paid service.
  5. When a domain’s expiration date approaches, renewal occurs only after receiving payment from the client in advance.
  6. Failure to pay for renewal results in the domain expiring, and after the period specified by the registrar, the domain may return to the pool of domains available for registration by third parties.

12. Final provisions

The Service Provider reserves the right to change these terms and conditions at any time. In matters not regulated by these terms, disputes are resolved individually, based on agreements between the Service Provider and the client.
